Criterios jurisprudenciales aplicados por la Corte Constitucional para definir el elemento esencial de la Constitución

Abstract

The reforms of the constitution are under the mandate of the Constitutional Court, by virtue of the provisions of art. 241 of the 1991 Political Constitution, where it has introduced in its jurisprudence the so-called substitution test in order to support the competence of the Constitutional Court to control the content of the reforms to the constitution. This research aims to specify the jurisprudential criteria used by the Constitutional Court of Colombia when identifying the essential elements of the constitution. It will study the cases in which the Court has used the substitution test and where the concept of essential element of the constitution was applied, exposing the argumentative lines of the Court's decisions, concluding that this entity does not apply clear and uniform criteria and sometimes does not use all the steps of the substitution test.

Las reformas de la constitución están bajo el mandato de la Corte Constitucional, en virtud de lo establecido en el art. 241 de la Constitución Política de 1991, en donde ha introducido en su jurisprudencia el denominado test de sustitución con el fin fundamentar la competencia del Tribunal Constitucional para controlar el contenido de las reformas a la misma. Esta investigación tiene como objetivo especificar los criterios jurisprudenciales utilizados por la Corte Constitucional de Colombia al momento de identificar los elementos esenciales de la constitución. Se estudiarán los casos en los que la Corte ha utilizado la prueba de sustitución y donde se aplicó el concepto de elemento esencial de la constitución, exponiendo las líneas argumentativas de las decisiones de la Corte, concluyendo que este ente no aplica criterios claros y uniformes en ocasiones no emplea todos los pasos del test de sustitución.
