International Humanitarian Law in the face of migratory movements

Abstract

The migratory route is a fertile scenario for the violation of human rights, in such a way that even though migrants have a wide range of instruments and instances that ensure their protection, International Humanitarian Law (IHL), an area that has delimited its object of study to international and non-international armed conflicts, has also shown interest in influencing migration. The objective of this work is to determine the way in which IHL can affect migration, which is demonstrated through the actions of the staff of the International Committee of the Red Cross, who provide support in migration stations and other places of the migratory route; Similarly, it is observed with the application of the corpus iuris of IHL when it is more favorable for the person. However, within the Mexican State there have been challenges that hinder the materialization of IHL, for this reason, dissemination, attention to expert meetings, consideration of the ratification of international humanitarian instruments, as well as the harmonization between domestic and international norms, are the axes that contribute to the implementation of IHL within the States.

La ruta migratoria es un escenario fértil para la vulneración de los derechos humanos, de tal manera que, a pesar de que el migrante cuenta con un amplio acervo de instrumentos e instancias que velan por su tutela, el derecho internacional humanitario (DIH), área que tiene delimitado su objeto de estudio a los conflictos armados internacionales y no internacionales,también ha mostrado interés por incidir en la migración. El objetivo del presente trabajo es determinar la manera en la que el DIH puede incidir en la migración, lo cual se demuestra a través de la actuación del personal del Comité Internacional de la Cruz Roja, quienes brindan apoyo en las estaciones migratorias y en otros puntos de la ruta migratoria. De igual manera, se observa la aplicación del corpus iuris del DIH cuando sea más favorable para la persona. No obstante, al interior del Estado mexicano se han presentado desafíos que obstaculizan la materialización del DIH; por esta razón, la difusión, la atención a las reuniones de expertos, considerar la ratificación de instrumentos internacionales humanitarios, así como la armonización entre la norma interna y la internacional, son ejes que coadyuvan en la implementación del DIH al interior de los Estados.
