Towards a convention for the use of artificial intelligence and robotics in armed conflicts: a view from the principles of IHL and the protection of the civilian population

Abstract

The intellection of the war instruments designed in the post-industrial era constitutes a challenge for international humanitarian law (ihl). The dizzying advances in technologies such as robotics and artificial intelligence have achieved the sophistication of combat weapons to such a dimension that it is possible to create robots to integrate armies, and that is why this research aims to justify the purposes that the law of armed conflicts must have in the current era, with objectives that must be oriented towards a legal engineering endowed with principles, rules and epistemological categories useful to avoid that robots end up dehumanizing war and leading us to worse historical atrocities such as those of the First and Second World Wars, events that justified the international community reaching consensus on ethical and legal minimums to limit the conduct of combatants in the heat of hostilities and safeguard the population no civil. The methodological route that was followed is that of qualitative, descriptive and legal dogmatic research.

La intelección de los instrumentos bélicos diseñados en la era posindustrial constituyen un reto para el derecho internacional humanitario (DIH). Los vertiginosos avances de tecnologías como la robótica y la inteligencia artificial han logrado la sofisticación de las armas de combate a tal dimensión que es posible crear robots para integrar los ejércitos, y es por eso que esta investigación pretende justificar los fines que debe tener el derecho de los conflictos armados en la era actual, con objetivos que deben estar orientados hacia una ingeniería jurídica dotada de principios, reglas y categorías epistemológicas útiles para evitar que los robots terminen por deshumanizar el conflicto armado y llevarnos a peores atrocidades históricas como las de la Primera y Segunda Guerra Mundial, hechos que justificaron que la comunidad internacional llegara a consensos éticos y jurídicos para limitar la conducta de los combatientes en el fragor de las hostilidades y salvaguardar a la población civil. La ruta metodológica que se siguió es la de la investigación cualitativa, descriptiva y de dogmática jurídica.
