%X This article aims to offer an interpretation of the International Humanitarian Law rules on depravation of liberty, both in international armed conflicts and in non-international armed conflicts, that takes in consideration transmasculine persons, transfeminine persons, non-binary persons and intersex persons. The reason for this is to be able to offer an adequate answer to the necessities, struggles and situations that these persons experiment amidst armed conflicts. International Humanitarian law, a body of law created by a society ruled by the sex-gender binary model, has not offered concrete answers to this day to said problem and the debate on the matter it’s still in its early stages.
%X Este artículo busca brindar una interpretación que permita aplicar las normas del derecho internacional humanitario (DIH) sobre personas privadas de libertad, tanto en el contexto de un conflicto armado internacional como no internacional, a las personas transmasculinas, transfemeninas, de género no binario e intersex. Esto, con el objetivo de brindar una respuesta adecuada a las necesidades, los problemas y las situaciones que ellas experimentan en contextos de conflictos armados, problemas para los que el DIH, creado en el marco de una sociedad modelada bajo el sistema binario de sexo-género, no ha brindado hasta ahora respuestas concretas y respecto de las cuales el debate se encuentra en ciernes.
