abstract = {The recruitment of children for their use in combat roles in non-international armed conflict contexts rises every year. However, among the rules of international humanitarian law there seems to be an absence of regulation on the targeting of children. Motivated by the strong moral weight assigned to the question, various authors have utilized a complementarity analysis between international human rights law and international humanitarian law to argue in favor of giving additional protections to children otherwise unprotected against direct attack. This paper argues that this is possible only in respect of the process of determination of the direct participation in hostilities or the continuous combat function of children, but not when this determination has already been made, because the fundamental principles of international humanitarian law may act as a logical limit to the complementarity analyses.},
abstract = {El reclutamiento de niños para su utilización en roles de combate en contextos de conflictos armados no internacionales aumenta cada año. No obstante, entre las normas del derecho internacional humanitario (DIH) parece existir una ausencia de regulación del targeting de niños. Motivados por la fuerte carga moral de la materia, varios autores han utilizado un análisis de complementariedad entre el derecho internacional de los derechos humanos (DIDH) y el DIH para argumentar el otorgamiento de mayor protección a niños desprotegidos contra el ataque. El presente artículo argumenta que aquello es posible solo respecto del proceso de determinación de la participación directa en las hostilidades (PDH) o la función continua de combate (FCC) de niños, mas no cuando esta determinación ya ha sido hecha, debido a que los principios fundamentales del DIH actuarían como un límite lógico para los análisis de complementariedad.},
