Ética del cuidado feminista y bioética personalista

We analyze the criticism launched by several representatives of feminist ethics against bioethics, its proposal for an ethics of care and what personalism proposes with respect to woman and bioethics. The objective is to develop a list of topics on which dialogue between the two can and should acquire greater depth. Above and beyond the difference in perspective in “masculine” and “feminine” individualist or utilitarian views of ethics, dialogue can be pursued and it is possible to look for complementarities through the paths opened up by several contemporary philosophers, both men and women, towards ethics that are rational, but focused more on the personal and human aspect.; Analizaremos la crítica que realizan algunas de las representantes de la ética feminista a la bioética, su propuesta de una ética del cuidado, y la propuesta del personalismo sobre la mujer y la bioética, para realizar una relación de temas en los que se puede y debe profundizar el diálogo entre ambas. Más allá de la diferencia de puntos de vista, de las visiones individualistas o utilitaristas “masculina” y “femenina” de la ética, podemos desarrollar el diálogo y buscar la complementariedad a través de las vías abiertas por algunos y algunas filósofos contemporáneos hacia una ética racional, sí, pero más centrada en lo personal y humano.; Será analisada a crítica de alguns dos representantes da ética feminista à bioética, su proposta de uma ética do cuidado e a proposta do personalismo sobre a mulher e a bioética para estabelecer uma relação dos temas nos que se pode e deve aprofundar o diálogo entre ambas. Para lá da diferença de perspetivas, das visões individualistas ou utilitaristas “masculina” e “feminina” da ética, podemos estabelecer um diálogo e procurar a complementaridade através das vias apertas por alguns filósofos e algumas filósofas contemporâneos para uma ética racional, centrada no pessoal e humano.

This paper deals with the legal and moral reasons that prevent the physician from taking a patient’s life. Among other reasons, medical doctors do not “kill” their patients because “killing” is not a therapeutic medical act. It does not reestablish the patient’s previous state of health, nor does it preserve life. If the state wants to allow euthanasia or assisted suicide, there is no constitutional reason why the relatives of a patient who is ill cannot euthanize or assist the patient in committing suicide. It is they, not the physician, who must answer to society and their own consciences for doing so.The article also offers a clear and precise look at Sentence C-239/97 issued by the Constitutional Court of Colombia and analyses the reasons why some of the articles in Senate Bill 05/07 are inconsistent with that sentence and, therefore, are unconstitutional.; En este artículo se exponen los argumentos por los cuales el médico está jurídica y éticamente impedido para matar a sus pacientes. Entre otras razones, los médicos no matan a sus pacientes porque “matar” no es un acto médico terapéutico. No restablece la salud y tampoco preserva la vida. Si el Estado quiere la eutanasia y el suicidio asistido, no hay ninguna razón constitucional que impida realizar el acto eutanásico a los familiares de los pacientes enfermos. Son ellos, y no el médico, quienes deben responder ante la sociedad y ante sus propias conciencias por ello. El artículo, además, revisa de manera clara y precisa la sentencia C-239/97 de la Corte Constitucional, y explica por qué algunos artículos del proyecto de Ley 05/07 del Senado no se ajustan a ella y son, por tanto, inconstitucionales.; Neste artigo expõem-se os argumentos pelos quais o médico está juridicamente impedido de matar os seus pacientes.Dentre outras razões, os médicos não matam seus pacientes porque “matar” não é um ato médico terapêutico. Não restabelece a saúde nem preserva a vida. Se o Estado deseja a eutanásia e o suicídio assistido, não existe nenhuma razão que impeça os familiares dos pacientes os levem ao cabo. Eles, não o médico, devem responder pelo ato ante a sociedade e as suas próprias consciências. Além disso, o artigo revisa de modo claro e conciso a sentencia C-239/97 da Corte Constitucional e explica porquê alguns artigos do projeto da lei 05/07 do Senado não se ajustam a ela e, portanto, são inconstitucionais.

This article examines the utilitarian ethics underlying biomedical research associated with the study of human embryos. The term preembryo is used as a legal pretence to ignore the ontological and biological reality of the embryo in its first days of life. As a result, the pre-implanted human embryo becomes part of the estimate of interests or assessment of consequences particular to utilitarian thics. Human life ceases to be regarded as a fundamental, ethical barrier to actual biomedical research with human embryos. The methodology is that of a descriptive and interdisciplinary study of the keys ethical values involved in this issue.; Este artículo examina la ética utilitarista que subyace en la investigación biomédica con embriones humanos. Mediante el término “preembrión” se institucionaliza jurídicamente un artificio que conduce a ignorar la realidad ontológica y biológica del embrión en los primeros días de vida. De este modo, el embrión humano preimplantatorio entra a formar parte del cálculo de intereses o balance de consecuencias propios de la ética utilitarista. La vida del ser humano deja de ser límite ético y fundamento para una verdadera investigación biomédica con embriones humanos. La metodología utilizada es el estudio descriptivo e interdisciplinar de las claves éticas que concurren en este tema.; Neste artigo, examina-se a ética utilitarista oculta além da pesquisa biomédica com embriões humanos. O vocábulo “pré-embrião” institucionaliza um artifício jurídico que leva a esquecer a realidade ontológica e biológica do embrião durante os primeiros dias de vida. Assim, começa formar parte do cálculo de interesses ou balance de conseqüências, próprios da ética utilitarista. A vida do ser humano deixa de ser limite ético e fundamento para uma verdadeira pesquisa biomédica com embriões humanos. A metodologia utilizada é o estudo descritivo e disciplinar das chaves éticas concorrerem neste tema.

The article offers a general description of the whirlwind sparked during slightly more than two centuries – as of the XVIII century – by a philosophical doctrine that began with the skepticism of the pre-Socratic era, briefly revived during the Enlightenment by Michel de Montaigne and others, to emerge solidly with the insular empiricists: Locke, Berkeley and Hume, who imposed their thinking to the point where it remains buoyant today, with numerous supporters among philosophers of three nonrealist lines of thinking on bioethics that are currently in vogue: sociobiologist, utilitarian pragmatic and radical liberal.; Descripción general del vendaval que causó durante poco más de dos siglos –a partir del siglo XVIII– una doctrina filosófica iniciada con el escepticismo desde la era presocrática, resucitada fugazmente en el Renacimiento con Michel de Montaigne y otros, para tener un sólido surgimiento con los empiristas insulares: Locke, Berkeley y Hume, que impusieron su corriente hasta encontrarla aun boyante, en la actualidad, con muchos adeptos entre filósofos de tres corrientes bioéticas no realistas en boga: la sociobiologista, la pragmático-utilitarista y la liberal radical.; Descrição geral da comoção causada há pouco mais de duos séculos –a partir do século XVIII– pela doutrina iniciada com o ceticismo desde a era pré-socrática, ressuscitada fugazmente no Renascimento com Michel de Montaigne e outros, e retomada pelos empiristas Locke, Hume e Berkeley, que a impuseram e todavia está em vigor. Esta doutrina tem muitos seguidores entre os filósofos das três correntes bioéticas realistas em voga: a sociobiologista, a prágmatico-utilitarista e a liberal radical.
