%X The application of the norms of International Humanitarian Law (IHL) in transitional justice, 
particularly those related to the granting of amnesties, has generated important debates that 
are still ongoing. As the main question, the paper seeks to answer whether or not a prohibition 
of amnesties for international crimes in IHL currently exists. According to the identified 
trends and practices of the States, is the per argues that these have not reflected, to date, an 
international custom to prohibit amnesties, nor the will to include a rule to this effect in IHL 
international treaties. However, there is a growing consensus, promoted especially by courts 
and human rights bodies, that amnesties for international crimes are incompatible with the 
obligations of States under international human rights law. This trend implies that the 
customary norm in question is currently crystallizing.
%X La aplicación de las normas de Derecho Internacional Humanitario (DIH) en la justicia 
transicional, particularmente aquellas relacionadas con el otorgamiento de amnistías, ha 
generado importantes debates que se encuentran vigentes. Como principal pregunta, el 
escrito busca responder si existe o no una prohibición de las amnistías de crímenes 
internacionales en el DIH. De acuerdo con las tendencias y prácticas de los Estados 
identificadas, se sostiene que estas no han reflejado, a la fecha, una costumbre internacional 
de prohibir las amnistías, ni la voluntad de incluir una norma en este sentido en tratados 
internacionales de DIH. Sin embargo, sí existe un consenso creciente, promovido 
especialmente por los tribunales y organismos de derechos humanos, frente a que las 
amnistías por crímenes internacionales son incompatibles con las obligaciones de los Estados 
a la luz del Derecho Internacional de los Derechos Humanos. Esta tendencia implica que 
actualmente la norma consuetudinaria en cuestión se encuentra cristalizándose.
