%X Through its jurisprudence, the Inter-American Court of Human Rights (IA Court HR) decides on the interaction between International Human Rights Law (IACHR) and International Humanitarian Law (IHL). This article demonstrates that the Inter-American Court of Human Rights has used IHL not only to interpret inter-American human rights instruments, but also to approximate the direct use of humanitarian norms, which creates a gray area between the interpretation and application of this area of Law. In doing so, the Court uses the lex specialis criterion if the IHL rule is the most specialized in the case; and selectively uses IHL specially to expand the content of human rights, but not necessarily to rule out possible violations of these, resulting in a sort of pick and choose methodology.
%X Por medio de su jurisprudencia, la Corte Interamericana de Derechos Humanos (Corte IDH) se pronuncia sobre la interacción entre el derecho internacional de los derechos humanos (DIDH) y el derecho internacional humanitario (DIH). Este artículo demuestra que la Corte IDH ha utilizado el DIH, no solo para interpretar los instrumentos interamericanos de derechos humanos, sino para aproximarse a la utilización directa de las normas humanitarias, lo que genera una zona gris entre la interpretación y aplicación de esta área del derecho. Al hacerlo, la Corte IDH recurre al criterio de la lex specialis si la norma del DIH es la más especializada para el caso; y utiliza selectivamente este derecho sobre todo para expandir el contenido de los derechos humanos, pero no necesariamente para descartar posibles violaciones de estos, lo que resulta en una suerte de metodología de pick and choose.
