%X El presente artículo brinda una panorámica de la evolución del Derecho constitucional, significando las mutaciones que ha tenido el concepto de constitución en relación con los cambios en sus contenidos, la renovación de sus 
teorías y el replanteo de sus roles. En un segundo momento, estudia el proceso de constitucionalización de la familia en Europa y América Latina, citando textos referentes y caracterizándolo de manera general. 
En ese punto, 
valora también la regulación de la institución en el Derecho Internacional de 
los Derechos Humanos y la incidencia que ha tenido la jurisprudencia de los 
órganos de justicia supranacionales de ambas regiones en la conformación 
ius commune familiar.
%X This paper provides an overview of the evolution of constitutional law, giving meaning to the changes in the concept of constitution as compared 
to the changes in content, the renewal of the theories and the reassessment 
of their roles. Then, the article studies the process of constitutionalization 
of 
the family in Europe and Latin America, citing related texts and characterizing it in general terms. The paper further evaluates the regulation of the 
institution of Human Rights in International Law and the impact of the jurisprudence of supranational bodies of justice of both regions in the creation 
of the 
ius commune familiar.
