abstract = {En el presente ensayo se realiza un breve estudio sobre la naturaleza jurídica de la institución del legítimo ejercicio de una actividad lícita, lo cual encierra el ejercicio de un oficio o profesión, desde luego acreditados por una institución universitaria y por el Estado (ejercicio de la Medicina, la Abogacía y los deportes, etc.) y siendo estos tomados como causal de exclusión de responsabilidad penal. En el desarrollo del trabajo, inicialmente, se definirán conceptos fundamentales para un mejor entendimiento de lo que se desea plantear en este escrito. Siendo este un tema tan discutido, se evidenciará el desacuerdo de los doctrinantes sobre el tema tratado, se plantearán tres teorías (institución de naturaleza atípica, naturaleza jurídica y carácter mixto entre la tipicidad y la antijuridicidad), citando los distintos autores que defienden cada una de teorías, para finalmente presentar la postura propia sobre el tema.},
